On December 11, 2023, SBA published in the Federal Register a Proposed Rule, Small Business Size Standards: Revised Size Standards Methodology (88 FR 85852). The purpose of the Proposed Rule is to advise  the public of the availability of a revised 2023 Size Standard Methodology (“white paper”) explaining how it establishes, reviews, and modifies its small business size standards, and to invite comments on that document.

As described in the supplementary information, the Jobs Act (Pub. L. 111–240, Sept. 27, 2010) requires SBA to review, every five years, all size standards and make necessary adjustments to reflect market conditions. SBA has completed the first and second mandated five-year reviews of size standards and is preparing to begin the next (third) five-year review.  According to the proposed rule, the revised white paper provides a detailed description of SBA’s size standards methodology, including changes from SBA’s 2019 Revised Size Standards Methodology which SBA intends to apply to the upcoming third five-year review of size standards.
