By email sent Monday, July 22, SBA provided notice that it had renewed/updated the following forms:
- , Secondary Participation Guaranty Agreement, (dated 12-2023) – mandatory contractual agreement between the lender, investor (Registered Holder), SBA, and the SBA Fiscal Transfer Agent (FTA) for the initial sale of the guaranteed portion of an SBA 7(a) loan in the secondary market.
- Lenders MAY use the new form to sell the guaranteed portion of an SBA 7(a) loan on or after August 1, 2024; and all documentation sent to the FTA [email protected] inbox on or after September 3, 2024 MUST include the new form.
- SBA advised that it had made both format and content changes to SBA Form 1086. Please see the referenced email for highlights of some of the changes and refer to the form for complete information.
- , Guaranty Loan Status & Lender Remittance Form (dated 12-2023) – form completed monthly by 7(a) lenders to report the status of all SBA 7(a) loans in their portfolios with an outstanding SBA guaranty, and to remit fees and payments to the FTA.
- Lenders MAY use the new form Month-End July 31, 2024 report period and MUST use the new form for the Month-End August 31, 2024 report period.
- SBA indicated that it had made minor changes to Form 1502 that did not alter the existing column format or the instructions for reporting through the Capital Access Financial System (CAFS 1502 Gateway). Please refer to the referenced email and to the revised form for complete information.
- , Form of Detached Assignment – form used by current registered holders to assign and transfer ownership in SBA certificates to secondary purchasers on the books and records of the FTA.
- Registered holders MAY use the new version of the form dated 12-23 in connection with transactions submitted to SBA’s FTA on or after August 1, 2024, and MUST use the new version for transactions received by the FTA on or after September 3, 2024.
- SBA reported that it had made no changes to Form 1088 except the addition of a Privacy Act Statement. Please refer to the form for that statement.
