SBA has advised that the revised SBA Form 1919, SBA 7(a) Borrower Information Form, has been cleared by the Office of management and Budget and is now available for use.  The form has been revised to update question 4 to reflect the regulatory changes in the Final Rule on Criminal Justice Reviews that took effect on May 30, 2024, and the implementing changes made to SOP 50 10 7.1 by SBA Procedural Notice 5000-857477Updates to SOP 50 10 7.1 and SOP 50 45 3 Related to the Criminal Justice Final Rule.

 While the form can be used immediately, the version now available is not in a fillable format and use of the form is not yet mandatory.  SBA has indicated that it will not be officially published until it has been made “508 compliant” (i.e., readable by screen readers for the sight-impaired).  After that happens, SBA will publish the fillable version of the form on its website and will issue an Information notice formally announcing the form and giving the date on which its use will become mandatory.

As revised, question 4 (p. 2) now reads:

Is the Applicant or any Associate of the Applicant presently currently incarcerated, serving a sentence of imprisonment imposed upon adjudication of guilty, or is under indictment for a felony or any crime involving or relating to financial misconduct or a false statement? (if “Yes” the Applicant is not eligible for SBA financial assistance.)

In accordance with the recent regulatory change, SBA has deleted from the question any reference to probation or parole since the Final Rule eliminated those statuses as a basis for finding a loan applicant ineligible for SBA financing.  According to information provided in SBA’s announcement of the availability of the new SBA Form 1919, the phrase “serving a sentence of imprisonment imposed upon adjudication of guilty” means that the individual is serving a sentence for a crime for which they have been found guilty. This definition includes individuals  who are “on house arrest or on home detention or work release or other similar programs”. 

The revised form also adds a borrower certification (p. 4) that authorizes SBA to release information about existing SBA loans to the 7(a) lender processing the loan application.
