In early January, IRS announced that, effective June 24, 2024, it would no longer provide tax return information via the Income Verification Express Services (IVES) and shortly thereafter lenders began advising NAGGL that they already were having difficulty registering for that system. But on March 6, 2024, IRS issued an  indicating that it was suspending the announced policy change to provide additional time for them to consider the concerns raised by IVES users and to reassess their ability to “provide income tax return information when necessary while keeping taxpayer information confidential and protected from disclosure.  SBA has confirmed this policy reversal stating  that lenders “may continue using the IRS IVES system to submit IRS Form 4506 in obtaining the Applicant’s (and seller’s) tax return transcripts for completing the required financial information verification process on their SBA loans”. We will be watching for additional guidance from IRS.
